OBJECTIVES OF THE PROGRAMME :
To provide the legal input, during the planning and implementation of the Organization's activities, so as to facilitate effective co-operation between those taking part - Member States, international bodies, international officials, collaborating institutions and individuals and commercial entities; to ensure that the activities are carried out on a firm legal basis; to protect the Organization's legal interests and defend it from legal action.
Description of duties:
Purpose of the position:
Provide legal advice and services, in particular in respect of:
- international administrative law;
- general protection of the Organization's interests; and
- any other functions as required, including on international, institutional or contractual legal matters.

Organizational context:
Work environment/role within team: The incumbent will be a member of the Office of the Legal Counsel, assigned to the International Administrative Law (IAL) team. While the post is within the IAL team, the incumbent may be required to work on legal issues arising in any area of the work of the Office of the Legal Counsel. The work environment requires a high degree of collaboration, both within the team and with other Office of the Legal Counsel (LEG) colleagues, as well as with colleagues in other departments. Although each of the professional staff members in LEG/IAL have areas of work in which he/she specializes, broadly speaking the incumbent will be required to carry out duties in all areas of work covered by LEG/IAL.

Available guidelines: There are very few guidelines directly relating to the work of the post. In so far as they may be relevant, the incumbent will however need to refer to the WHO Constitution, World Health Assembly (WHA) and Executive Board (EB) resolutions and decisions, treaties, customary international law and general legal principles, WHO Regulations and Rules, WHO Manual, established policies and practice of the Organization (including the WHO Framework of Engagement with Non State Actors). The incumbent will normally need to interpret guidelines to particular situations. He/she may need to develop new guidelines that are consistent with the approach decided by the Principal Legal Officer, IAL and/or the Legal Counsel, and which may involve a new approach or solution for WHO, in the light of its practice and the need to protect the Organization.

Nature/Purpose of contact within/outside WHO: The incumbent will have contact with senior officials within WHO HQ, and WHO Regional and country offices.
Purpose: to provide legal advice and services on issues within the incumbent's post description.

Contacts outside WHO will include:
(i) government representatives; senior civil servants; and senior officials of other common system organizations.
Purpose: to explain and discuss legal matters, as WHO's representative;

(ii) representatives (including lawyers) of institutions, Non-Governmental Organizations (NGOs) and foundations.
Purpose: to discuss the legal aspects of collaborative projects;

(iii) staff of academic and other public institutions.
Purpose: to provide information on the legal aspects of WHO activities, and when applicable, discuss the legal aspects of collaborative projects.

Summary of assigned duties:
Under the supervision identified above, the Legal Officer will:

1. Prepare legal advice on diverse substantive and procedural questions, which may include matters related to international administrative law, privileges and immunities, national legal systems, contractual arrangements, intellectual property issues, publications, planned collaborations, institutions support, WHO governance, policies and procedures, and other operational matters.

2. Draft notes, opinions, memoranda on legal questions, for consideration by the first-level supervisor, the Principal Legal Officer and/or the Legal Counsel.

3. Perform extensive legal research and analysis and prepare legal opinions, studies, briefs, reports, and correspondence.

4. Assist with preparing and filing of statements and motions before international courts and other appeals bodies, in particular the International Labor Organization Administrative Tribunal (ILOAT).

5. Assist in the development of new legal forms and templates, as required, in English and French.

6. Participate in negotiations and settlement of claims and disputes.

7. Any other activity as deemed appropriate by the first-level supervisor and/or the Principal Legal Officer.
REQUIRED QUALIFICATIONS
Education:
Essential:
Master's Degree (or equivalent university degree) in law.

Desirable:
Specialization or degree in international law.
Legal studies of more than one legal system.

Experience:
Essential:
Seven years of experience practising law, within the legal department of an international organization, with a national or international legal body, a company, or in a law firm.

Desirable:
Experience as a lawyer in different jurisdictions.
Experience in negotiating and drafting agreements or contracts in a broad range of areas.
Experience practising law in an international context .
Languages:
Essential:
Expert knowledge of English and French.

WHO’s salaries are calculated in US dollars. They consist of a base salary and a post adjustment, which reflects the cost of living in a particular duty station and exchange rates. Other benefits include: 30 days annual leave, family allowance, home travel, education grant for dependent children, pension plan and medical insurance.

Annual salary: (Net of tax)
USD 69'032 at single rate
USD 74'130 with primary dependants
Post Adjustment: 80 % of the above figure(s). This percentage is to be considered as indicative since variations may occur each month either upwards or downwards due to currency exchange rate fluctuations or inflation.
