OBJECTIVES OF THE PROGRAMME :
To provide the legal input, during the planning and implementation of the Organization's activities, so as to facilitate effective co-operation between those taking part - Member States, international bodies, international officials, collaborating institutions and individuals and commercial entities; to ensure that the activities are carried out on a firm legal basis; to protect the Organization's legal interests and defend it from legal action.
Description of duties:
Purpose of the position:
Provide legal advice and services, in particular in respect of the Office of the Legal Counsel's (LEG) support to the WHO Health
Emergencies Programme (WHE), including:
- general protection of the Organization's and The Programme's interests; and
- any other functions as required, including on international, institutional or contractual legal matters.

Organizational context:
Work environment/role within team: The incumbent will be a member of the Office of the Legal Counsel, assigned to the Governing Bodies and Public International Law (GBI) team. While the post is within the GBI team, the incumbent may be required to work on legal issues arising in any area of the work of the Office of the Legal Counsel.
The work environment requires a high degree of collaboration, both within the team and with other offices of the Legal Counsel (LEG) colleagues, as well as with colleagues in other departments. Although each of the professional staff members in LEG/GBI have areas of work in which he/she specializes, broadly speaking the incumbent will be required to carry out duties in all areas of work covered by LEG/GBI.

Available guidelines: The incumbent will need to refer to the WHO Constitution, the International Health Regulations (2005), World Health Assembly (WHA) and Executive Board (EB) resolutions and decisions, treaties, customary international law
and general legal principles, WHO Regulations and Rules, WHO Manual, and established policies and practice of the Organization (including the WHO Framework of Engagement with Non State Actors).

The incumbent will need to interpret guidelines in particular situations. He/she may need to develop new guidelines that are consistent with the approach decided by the Principal Legal Officer, GBI and/or the Legal Counsel, and which may involve a new approach or solution for WHO, in the light of its practice and the need to protect the Organization.

Nature/Purpose of contact within/outside WHO:
The incumbent will have contact with senior officials within WHO HQ, in particular WHE, and WHO Regional and country offices.
Purpose: to provide legal advice and services, including on agreements, operational and logistical matters and on other issues arising in connection with the WHO Health Emergencies Programme.

Contacts outside WHO will include:
(i) representatives (including lawyers) of companies, institutions, Non-Governmental Organizations (NGOs) and foundations. Purpose: to discuss the legal aspects of collaborative projects and negotiate contracts.

(ii) government representatives; senior civil servants; and senior officials of other common system organizations.
Purpose: to explain and discuss legal matters, as WHO's representative.

(iii) staff of academic and other public institutions.
Purpose: to provide information on the legal aspects of WHO activities, and when applicable, discuss the legal aspects of collaborative projects and negotiate arrangements and agreements.

Summary of assigned duties:
Under the supervision identified above, the Legal Officer will:

1. Prepare legal advice on diverse substantive and procedural questions, including on matters related to partnership agreements, funding agreements, data sharing arrangements, operational and logistical arrangements (including, for example, medical evacuation plans), planned collaborations, institutions support, WHO governance, policies and procedures, and matters related to the International Health Regulations (2005), as directed by the Principal Legal Officer GBI.

2. Draft notes, opinions, memoranda on legal questions, for consideration by the Principal Legal Officer and/or the Legal Counsel.

3. Perform extensive legal research and analysis and prepare legal opinions, memoranda and correspondence in support, in particular, of theWHO Health Emergencies Programme, and as needed.

4. Assist in the development of new legal forms and templates, as required, in English and French.

5. Participate in and, where appropriate, coordinate negotiations on arrangements as referenced above.

This work involves working on legal and policy issues relating to relations with both public and private sector entities. In addition, the work may involve funding and co-operation agreements with governments, funding agencies and NGOs, including related project documents. Issues with implications for other units, within LEG and the Organization as a whole, will be carefully and fully coordinated.

6. General protection of the Organization's legal interests in specific areas such as use of the WHO name and emblem, co-sponsorship of meetings for which commercial involvement is an issue, conditioning of acceptance of donations, and general legal questions confronting international organizations.

7. Other activities as deemed appropriate by the Principal Legal Officer.
REQUIRED QUALIFICATIONS
Education:
Essential:
Postgraduate university equivalent degree (or equivalent academic qualification) in law.

Desirable:
Formal studies in international law.

Experience:
Essential:
Seven years of experience practising law, within the legal department of an international organization, or with a national or international legal body, a company, or a law firm focusing on international organizations.
Experience practising law in an international context.
Experience negotiating and concluding international agreements.

Desirable:
Experience as a lawyer in the operational work of an international organization.
Experience as a lawyer in international organization governance.
Languages:
Essential:
Expert knowledge of English and French.

Desirable:
Intermediate knowledge of another WHO language.

WHO’s salaries are calculated in US dollars. They consist of a base salary and a post adjustment, which reflects the cost of living in a particular duty station and exchange rates. Other benefits include: 30 days annual leave, family allowance, home travel, education grant for dependent children, pension plan and medical insurance.

Annual salary: (Net of tax)
USD 69'032 at single rate
USD 74'130 with primary dependants
Post Adjustment: 80 % of the above figure(s). This percentage is to be considered as indicative since variations may occur each month either upwards or downwards due to currency exchange rate fluctuations or inflation.
